International action in defense of dismissed trade unionist from IKEA Industry Lubawa

In February 2023 NSZZ “Solidarność” together with LabourStart prepared an international action to support Dariusz Kawka, trade union activist fired from the Lubawa Branch of IKEA Industry Poland. Participation in the action was very simple. All you had to do was to provide your data and click, thus sending a petition.

‘Dariusz Kawka, leader of NSZZ “Solidarność” in IKEA Industry Poland Ltd., was dismissed on disciplinary grounds – in violation of the law. His status as a chairman of the trade union local means that this intention should have been consulted with the board of company trade union organization prior to his dismissal. This did not happen. The State Labor Inspectorate confirmed that Dariusz’s dismissal was a gross violation of Polish labor law’ – write the originators of the action.

The organizers ask to take a moment and support the union in the fight to reinstate Dariusz. ‘Tell IKEA that it must respect workers’ rights – and the law,’ they urge.

What is at stake? Reinstatement of Dariusz Kawka – leader of NSZZ “Solidarność” in Ikea Branch in Lubawa, who in November 2022 was dismissed on disciplinary grounds from his job without a notice period. The inspection conducted by appropriate authorities found gross violations of the law by the employer.

The document confirmed, among other things, that the company trade union organization of NSZZ “Solidarność” in Lubawa Branch of IKEA did not agree to terminate the employment contract with chairman Kawka, which the employer did anyway.

‘Moreover, taking into account that the offense referred to in Article 281 § 1 item 3 of the Labor Code, i.e., termination of the employment relationship with an employee without notice, thereby grossly violating the provisions of the labor law, was committed, the labor inspector, immediately after the completion of inspection activities, initiated actions in terms of misdemeanor proceedings against the person responsible for the commission of this offense,’ the document conveyed.
